DISGRACE#01 Mohd Eusoff Chin, Chief Justice of Malaysia from 1994 – 2000, subjected himself to the worst kind of corruption, by ‘tagging’ along lawyer V.K. Lingam on a family vacation in New Zealand in 1994. He subsequently lied to the Royal Commission of Inquiry on the Lingam tape scandal.

S. Augustine Paul

DISGRACE#02 S. Augustine Paul, formerly Federal Court judge, subjected himself to be a political whore when in 1998, while being a Kuala Lumpur high court judge, participated in the political conspiracy orchestrated by then prime minister Mahathir Mohamad. He put through a show trial of then-deputy prime minister Anwar Ibrahim and subsequently convicted the latter of sodomy and corruption. Among his notorieties, he allowed the prosecution to change the time of offence three times when Anwar’s lawyers provided the alibi. He died on Jan 2, 2010 after two years’ struggle with pancreatic cancer.

DISGRACE#03 Ahmad Fairuz bin Sheikh Abdul Halim, Chief Justice of Malaysia from 2003 to 2007, was taped in the ‘judicial fixing’ scandal where he was heard in conversation with lawyer V.K. Lingam, on how to get Fairuz to be elevated as chief justice of Malaysia. He subsequently lied to the Royal Commission of Inquiry that he was not the other party in the said telephone conversation.

DISGRACE#04 Ridwan bin Ibrahim, currently judicial commissioner of Ipoh high court, participated in the aftermath of Perak state coup by Najib Tun Razak. He first created the stir when he infamously ruled that five lawyers appointed by Perak State Speaker V. Sivakumar had no locus standi to represent Sivakumar. The astonishing ruling forced Sivakumar to be unrepresented effectively, as his ruling also stated that Sivakumar can only be represented by the state legal advisor, who has been shown to be colluding with the illegal menteri besar Zambry.

DISGRACE#05 Ramly bin Hj Ali, currently a judge at the Court of Appeal, took side on the Perak MB vs. MB on May 12, 2009 when he alone heard the appeal from BN menteri besar Zambry and granted him stay of execution on the High Court ruling, which declared Nizar as the legitimate menteri besar. Ramly’s hearing the appeal alone was a serious departure from the norm of the Court of Appeal, which hears cases in panel of at least three judges.

DISGRACE#06 Balia Yusof bin Haji Wahi, currently a judge at Kuala Lumpur high court, dismissed on Apr 1, 2009, Perak state assembly speaker V. Sivakumar’s application to strike out summons by brought by the three independent assemblymen, seeking a declaration that Sivakumar’s order to declare their assembly seats vacant was illegal.

Balia Yusof’s decision is a stark violation of the very fundamental of separations of powers, where proceedings in the Legislative Assembly of any State cannot be intervened by the court.

Sheriff, currently president of the Court of Appeal, ruled on Apr 16, 2009 that Perak Assembly Speaker V Sivakumar does not have the power to suspend Mentri Besar Datuk Zambry Abd Kadir and six state executive council members from attending the assembly. It is a decision that was made in blatant defiance of Article 72 (1) of the Federal Constitution which says,”The validity of any proceedings in the Legislative Assembly of any State shall not be questioned in any court”.

    7 out of the 10 are disgraced due to their involvement in the Sivakumar, Zambry et al issue. Are you implying that Malaysian judges are, if not for the Perak fiasco, morally upright defenders of peace and justice? It sure looks that way. Sorry to be buzzkill, but I think that any shaming process should be more comprehensive. Many, many Malaysians have suffered under the yoke of an oppressive government.

    And Hamid Omar, who presided in the panel against his boss, Salleh Abas, whom he succeeded after finding Salleh guilty of judicial misconduct.

    And have we not read Zainon Ali’s reasoning in her judgement in the MB v MB court of appeal case? What a load of rubbish.

    You list many of them because of their involvement in the Perak case in one way or another. Is it so easy to get listed anywhere at all ? Judges are not supposed to be infellible. Thats why we have avenues for appeal. But when it comes to the very fundamental of constitutional law which every law student must read and pass an exam on, it makes me wonder whether some of our judges passed their law at all.

    Our Constitution has withstand over 40 years of scrutiny. It has almost never been found to be flawed in its practicality and its philosophy. I admire the wisdom of the few great jurists who wrote it. Sadly, some of our judges do not even understand what are written in our constitution. England has no written constitution. Ours is a written version of what they practise. Just imagine what we would have become if ours is also not in a written form.

    Like a ball game. Others play and follow the rules without problem. Malaysia plays with the rule book placed by its side, yet they do not know what the rules are and the matches always end up with a free for all.

    The Law of Karma (as it is known in Buddhism) applies to everyone regardless of one’s faith as it will either punish or reward the person who does evil or good deeds in his/her lifetime on earth. Every religion has its own version of law that punish or reward deeds done by its followers. The name of the law in the respective faith is immaterial as the consequences of one’s action will invites or invoke the divine laws of one’s religion on the person who consciously or deliberately acted with intention whether for self-interest or the public good. Rest assured that these judges of HOS will be accountable to their evils deeds with their Creater in whatever name it is called.

    Anwar Ibrahim’s dismissal as deputy premier and finance minister on Sept 2, 1998 was lawful, as the prime minister has absolute power to appoint or revoke the appointment of its minister, the Federal Court unanimously ruled this morning.

    President of the Court of Appeal Alauddin Mohd Sheriff said the court has no doubt that the prime minister (then, Dr Mahathir Mohamad) had advised the Agong to revoke Anwar’s appointment to the two posts.

    Alauddin said as the constitutional monarch has limited role concerning the appointment of Cabinet ministers as the power to choose to appoint resides with the PM.

    “His majesty does not have any discretion to reject or question the discretion of the PM. Revocation of the appointment equally lies with the PM… that it (PM) is the only authority to appoint (also) has the right to revoke the appointment.

    “Furthermore, there is an affidavit by the special officer of the (Agong) which was not disputed that the Agong had assented to the decision.

    “The Court of Appeal had also ruled the failure of his opponent (Anwar) to dispute is usually treated as an admission by him of the fact asserted.”

    Clear demarcation of powers

    In view of what Alauddin described as clear demarcation of power between the Prime Minister and the King, the judge said it was imperative to realise the cabinet’s role of collective responsibility.

    He further pointed out that the Agong, as constitutional monarch, shall act on the advice of the prime minister and the cabinet to revoke any appointment.

    “We find that Anwar’s contention that it was the PM who had effected the revocation and not the Agong is fallacious and untenable.”

    Noting that the dismissal was legally revoked, the judge said Anwar’s legal suit “is unsustainable and dismissed with costs”.

    Justice Mohd Ghazali Mohd Yusoff and Justice Abdull Hamid Embong sat with Justice Alauddin.
